well a new draft a marriage and family section of the Civil Code have been submitted to the ongoing bimonthly session of the National People's Congress Standing Committee the top legislature. And four years debt has been jointly paid off by divorcing couples regardless of who accrue. That's the marriage law of the People's Republic of China passed in 1981. It stays that the time of divorce debts incurred by the husband and wife during their marriage shall be paid off out of there jointly possessed property. And then in December 2003, the interpretation of this marriage law said article 24 stipulated during the existence of the marriage if either the husband or wife Falls for a claim for a personal debt in the name of the party, the debt shall be treated as a joint debt of the husband and wife. So join debt. But in 2018 the Supreme People's Court issued a judicial interpretation on the law. It clarified the division of debt by “Joined debts, both signatures”, which means husbands and wife should not have to pay for their partner's excesses and that is a big adjustment. Well this is the third review of the marriage and family section of the civil court in question besides a couple strong debts. They also being looked at are the legal age for marriage the right to know a potential spouse's health before marriage. The legislative confirmation of the couple's joint that's remains in focus during the third review. The second draft issued in June said “Debts incurred by one spouse for use beyond the scope of family and necessities are not considered join debts, unless the creditor can prove the debt has been used for family or business jointly run by spouses or incurred with mutual consent.” However it is still vague on what family necessities refers to exactly or what a joint business operation means. All of this needs further clarification and the third review. And on the legal age for marriage the third review indicated on Monday that China's age will remain unchanged. at 22 for men and 20 for women. Legal expert have suggested lowering the age considering the falling marriage rate growing divorce rate and aging population. The review of the third draft suggests more research and scientific assessment are needed before making adjustments to the marriage system. Finally the third review said that one spouse with serious disease should tell the other before marriage if not the other could invalidate the marriage. China abolished compulsory premarital checkups in 2003 but the percentage of disease found in the checks has increased.
